Oken gutter and never sealed roof cap after roof install

I bought my house in aug. 2011. Part of the purchase contract was a new roof tranferable to me. Never thought twice about the work that was done till this summer of 2012. Water build up in rear of the house from gutter leaking. Call a company out to give est. And said gutter hanger was broken and someone nailed it up so it didnt hang. The roof also has a cap on the roof that has very little flashing at all and its not sealed at all. Bad bad bad. I just would like to see it repaired.
