Deposit Refund

I signed an agreement for a circular driver to be done on 2/17 with Mr. Jorge Mercado: Decorative Landscape Edging / Mercado's Painting. Mr. Mercado failed to contact me for the start of the job, until I called him three months later (he was working on other properties at that time) he basically told me that he was waiting on me to notify him when to start the job. Since then, I changed my mind. I could not afford the $ 9000.00 price tag that was quoted due to unexpected financial hardship and family illnesses. He came over the house again convincing me that he can modified the plan and decrease the price from $ 9000.00 to $5,000.00. Unfortunately at that time, I was still no longer interested. I requested my refund. He kept stalling me, by telling me that he is waiting for his business partner Mr. Fidencio Esquivel (772) 446-5878 to sell the culvert (the metal pipe that goes at the end of the drive for proper drainage) he purchased with my deposit. Just to verify what he was telling me I called the company (Southern Culvert A Contech Company, 1031 Digiorgio Road,: Fort Pierce, fl 34982-6447, Phone: (772) 464-4400) and they had no record of Mr. Mercado or his business partner had purchased any culvert in the past months. I spoke with Mr. Fidencio on several occasions and he has revealed that his business partner Jorge has no attention of refunding my deposit and he has been lying to me and the fact that Mr. Mercado kept the deposit money for himself. I have called Mr. Mercado at least once every two weeks in the past few months and he still keep promising me that he will return my money. However, on 6/14 he called and threating me, Mr. Mercado states that he was going to sue me for the $9,000. Frankly, I'm not sure on what basis, because he kept my deposit and no work was ever done. I pray that he will realize that he's wrong for not keeping his word and stealing is a sin!
