City Of Stafford, Texas large ripoff

In 1990, the City of Stafford decided without the advice and consent of the residents to put new underground drainage in the new section of Vaccaro Manor in Stafford. At great, unnecessary expense to the city, this was accomplished by turning off the water at unpredictable intervals stranding residents in the shower with soap and shampoo on them, leaving the entire neighborhood in mud, standing cars in driveways far above the new street beds, and causing folks to park blocks away from their homes to carry groceries home.

I say unnecessary because Lawrence Vaccaro, the City Planner, has been quoted as saying that the necessary drainage work, for 5-7 residents of Venice Circle, could be done for a few thousand dollars. The same approach was used in Missouri City Estates. However, Vaccaro manor residents got presented with bills for many thousands of dollars for unwanted and unneeded work, while their requests for recompensation for damages done were ignored.
Frank and Karen suffered many thousands of dollars of damage to his property at the hands of Stafford, and yet had $8,130.19 taken from his proceeds at closing in August of last year!

The city claimed a lien filed in the early 90's for the "Vaccaro Manor Massacre" as the basis for this hijacking of funds, but there is more.
Frank and Karen refinanced the house in and the title search showed no lien! Furthermore, a letter was requested and received from the City stating that "no money is owed to the City on this property."
These documents are a matter of record and are retained by AmeriQuest Mortgage.

There was no lien as of but one of the people that made an offer on the house in 2002 was a city council member. He made a ridiculously low offer, which was turned down, and shortly there after the lien showed up when a reasonable offer was made and accepted. He was of course, told that Frank refused to pay streets assessment or even acknowledge that charge until Stafford owned up to the damages done to the residents.

Some long term residents may remember when Frank opposed Leonard Scarcella for mayor in 1995. Among the many issues that he brought to the forefront were the streets, the Vaccaro Manor Massacre, annexation and Leonard's ill-founded tax program. Perhaps the tax shortfall Stafford is seeing now is being deferred a bit by taking money from residents?

Attempts by Frank to recover his $8,130.19 have been met with letters from lawyers, but no offer of settlement or negotiation by the City.
