The contract states for repair of stucco approximately 4 feet off the ground, only a patch job to one side of chimney was done, paint colours show work done. Will provide latter photo's. Neighbor paid contractor as I wasn't in area to see work preformed. The General Agreement is as follows:

This agreement made this 17th day of June, by and between Contractor Jason Fausette/Onsite Residential and Dwayne Cook (Second Party, hereinafter called the Owner).

The Contractor and Owner for the conditions agree as follows: I. Scope of work: Onsite Residential shall furnish all materials and perform all of thework on the property at: Blank (personal address). Onsite Residentialwill repair roof and stucco.

II. Contract price: The Owner shall pay Onsite Residential for material and labor to beperformed under the sum of $825 dollars. The total price includes $375 for the roof repairat the chimney and $450 for repair of stucco approximately 4 feet off the ground. Iii. Payments of contract price shall be made as follows: The total cost of work, $825, payable all labor and materials, must be met on 06/21/10.

IV. Time of Performance The work shall be: Started on: 06/17/10 Completed on or аbout: 06/20/10

V. Completion: The work shall be considered completed upon approval by Homeowner, provided the Homeowner’s approval shall not be unreasonably withheld. Substantialperformance of the specified work in a workmanlike manner shall be consideredsufficient grounds for Contractor to require final payment by Homeowner.

VII. Liens and Waivers of Liens: Homeowner and Contractor agree that Homeownershall be protected against liens if FINAL payment is received by the date agreed above insection III.

VIII. Warranties: Onsite Residential agrees to warranty all work for one year after thecompletion date.

IX. Change Order Requests: Should a change be made to the established plans for theproject as detailed on the estimate, a change order will be issued for the additional work. Such changes will be put in writing, signed by the parties, and added to this contract.

X. License Status and Number: Contractor shall comply with all state and locallicensing and registration requirements. Contractor’s state license is CBC 1256269.

XI. Liability Waiver: If contractor is injured in the course of performing the work, Homeowner shall be exempt from liability for those injuries to the fullest extent of thelaw.

XII. Site Maintenance: At the end of each day’s work, Onsite Residential agrees toclean all debris from the work area and leave all appliances and facilities in good workingorder, or to confine all work-related activity, materials and products, including dust anddebris to the work area.

XIII. Permits and Approvals: Onsite Residential shall be responsible for determiningwhich permits are necessary and for obtaining the permits. Homeowner shall be responsible for obtaining approval from the local homeowner’sassociation, if required.

XIV. Dispute Resolution: If any dispute arises under the terms of this agreement, theparties agree to select a mutually agreeable neutral third party to help them mediate it. Ifthe mediation is deemed unsuccessful, the parties agree that the dispute shall be settledaccording to the laws of Florida. Each party shall pay his or her own attorney fees.

XV. Other terms to be observed by and between the parties:

This agreement shall be binding upon the parties, their successors, assigns and personal representatives. Time is of the essence on all undertakings. This agreement shall be enforced under the laws of the state of Florida. This is the entire agreement. Signed the day and year first written above.
