In early March I received notice of a proposed assessment from the California franchise tax board. This assessment as a result of a mistake by the tax club in preparing my 2007 income tax report. The tax club prepared my IRS report and showed a salary of $120,000 but failed to note $20,500 was placed in a retirement account and shown in box 12. On the California tax report she correctly showed the wages of $99,500. I contacted the tax club and made several calls regarding this problem after several calls a person name Warner did contact me around the middle of March. He stated that he would request this matter matter be continued as he was too busy at that time due to the tax deadline upcoming.
If the matter had been taking care of at that time it would be within the three-year filing deadline for the IRS
on October 15 Mr. Warner sent me the information needed to file with the IRS and request that I be refunded the over payment of 5125. I asked Mr. Warner how his employee could make such a big mistake. He responded by saying people make mistakes. I would expect more from a certified public accountant, and the tax club employee had assured me that this return would be reviewed by her superior to ensure that it was correct and accurate. Obviously this was not done.
The refund for the $5125 was denied by the IRS as it past the three-year window. I asked Mr. Warner if the tax club would make restitution to me. He said we get back on and as of this date I have not heard from the tax club.
The tax club accountants mistake cost pay $5125 and as it was their mistake they should make restitution.
