Refuse to return money for a defective item

On October 17th my husband (who was dying of cancer) purchased a pair of tanzanite earrings. At the time of purchase he asked if the posts were screw post and was told yes.

On 10/24 we received the earrings and when I tried them on they would not stay in my ears because they had the standard post and they could not support the weight of the earrings. He really wanted me to have these since he knew he would not be here for Christmas. I returned the earrings, insured and return receipt requested on 10/25. When we didn't get the green receipt back my husband called them and was told that he would get the refund in 30 days minus a 15% restocking fee. I have yet to figure out why you would restock a defective item. Needless to say I was disappointed that I did not have these earrings as a last gift from my husband.

When he called they said that they had received it on 11/7 and we would be getting a refund in 30 days. Meantime my husband passed away so when I called on 12/6 I was told it would be 30 business days and that I should have my money on the following Monday. Ever since then I have made many calls, been put on hold for a total of 11 3/4 hours, transferred to Tina (who is apparently the only person who does refunds) left at least 6 8 messages for her only not to get a return call.

I contact the Governors Office of Consumer Affairs and they sent them a letter to which they have not bothered to respond. I called my local TV Action Line and they have not had any success getting through. One of the problems is they don't even open their customer service lines until 1:00 pm California time.

I am now widowed, there was no life insurance and I am dealing with trying to keep a roof over my head and my 34 yr. Old mentally challenged daughter and I could really use that money. Any help would be greatly appreciated. Thank you.
