UPS returns item to me even though I did not request a signature!

UPS returned a box that I had shipped to PA that cost $15.00 to ship... Stating 3rd attempt... EVEN THOUGH I DID NOT REQUEST A SIGNATURE! UPS says that it is up to the driver to leave a package or not with out a signature... How about what the shipper/payee says!

They then said it was because it going to an apartment... So an apartment is not safe as a home? My driver NEVER gets a signature at my house and leaves packages in the rain to get wet! I will be doing a chargeback on my AMEX card!
