Failing Double Pane Windows

Almost half of all the custom windows that I purchased from Bogle Glass in Harrison, Arkansas, have failed, and have lost their thermal seal. Their is condensation between the panes. The windows are only 5 years old. They have since gone out of business and I have learned that my order was one of the last windows that they made. Are there any other customers out there that this has happened to? Is there any recourse?
