Swim Spa purchased in July still not operational

On 7-20-08 I paid $12,000 for a used swim spa which was supposed to be installed ASAP which included crane cost, taking down of 15x30 pool, provide base for swim spa, electrical hookup, install pondless waterfall, fill in area where pool was around spa. I traded in pool chemicals, a new cover, and the liner. It was a year before the swim spa was delivered and I paid for the delivery which was supposed to have been included. The people who delivered the first load of railroad ties to provide landscaping tried to charge me $500 which I told him I had already paid in full. I ended up paying 1/2 of the $1200 electric cost which was supposed to be included. My part was paid in the job was finished in 2010. I had to pay for fill-in, people to shore up the aluminum liner which was being pushed in and find more railroad ties and it could use more. I never know when someone is coming out and it can be weeks between visits. The 1500 gallon swimspa was filled and drained 4-6 times over the summer looking for where it was leaking. It has never worked more than 2-3 days at a time. I call and am promised a time to come out and they don't show and don't call and make excuses for why they can't come out and finish the job. I am tired of this and want it to work or my money back.
