Sold used, damaged ipod as new

My 16 year old son had been saving up his money to buy a new ipod. I dropped him off at Circuit City in Waldorf, Md. He took the tag off the shelve showing a 10% discount over to the customer service area. They went in the back and brought him the IPOD and he asked if everything was there and the clerk told him yes. When he got to the car and opened the package the headphones ($50) instructions, CD and usb cord were missing. When he turned it on it asked for a password. Evidently it was returned and damadeged merchandise. I immediately went back into the store to exchange it or exchange it and was told by by Pamela that they gave no refunds. I asked for her manager and Mr. Godwin said all slaes were final. He is the same individual that got the IPOD FROM THE BACKROOM. I then asked to speak with his supervisor and he said that he was that store manager and didn't have one. I asked for the name of the company that was running the sale for CIRCUIT CITY and he wouldn't give it to me. What a rip off!!! My son is out $420.00
