Stole our money and did not deliver our computer

I entered into a written agreement with Matt build a custom PC. I was told that I would have delivery on 2-20-10 (one week later), although the contract stated that delivery would 2-27-10. On 2-19-10 I left numerous messages for Matt with no return call. That evening a new message on is recorder said said " due to unforseen circumstances our business will be closed until 2-26-10 but any custom orders would be delived 2-27-10. I finally reached Matt on 2-23-10 and told him that I was really upset and what was going on as I had found numerous negative stories on the internet about the way he does business. He said there had been a death in his family which I did not believe because I had read that this was a much used excused given by him to others he had scammed. He promised that I would have my PC on 2-27-10 and we made an apointment for 12:00-2:00 pm. I called when he didn't show up and another voice recording said that his busness was closed due to unforseen circumstance and would reopen 3-1-10. He stole my money and I have no computer.
