Citi-Spaces Refusing to Refund $3000 deposit

I was shown an apartment at 110 Green Street on March 7th. I agreed to rent the space beginning April 15th. I submitted deposits to Citi-Spaces in the amount of $3000 and a $3000 check to the owner, 110 Green St LLC. Subsequently the building was sued and all work halted. I asked for a refund of my deposits on April 6th. The owner had not cashed my check so I issued a stop payment on it. Mr. Frank Fellini, the broker, assured me I would be getting a refund and would let me know when.

AFter a few days of not hearing from him I called his office and was told to speak to his manager, Mr. Israel Horowitz who happens to own the company. He assured me my deposit would be forthcoming. I have heard nothing since. My calls now go unanswered. I am filing a complaint with the New York Attorneys General office and with Real estate licensing board here:

I do not know if this is just ineptitude or outright fraud but time will tell.in the meantime I would be careful dealing with this company, especially with Manhattan real estate in free fall.
