Sold a server under false pretenses

Before buying a raid server I asked Troy if it could share files between 5 Mac workstations without needing software such as Apple's XSAN software to share files. He said it will share files right out of the box and nothing else was needed. After trying to make it work, I told him it didn't work and he said I needed XSAN software. When I told him that I can't afford it he found another software product called FiberShare and he and the software sales person convinced me to buy it to see if it will fit our needs. It didn't fit our needs and now Troy says they won't take the server back because there is nothing wrong with it. Doesn't selling something under false pretenses consititute something "wrong" with it?
