Wouldnt replace 3 week old defective phone

I purchased a Samsung Messager on Oct 9. The phone wouldn't charge starting on Oct 31 & speakerfone wouldn't work. Neither would mp3 or any other sounds.

Cricket replaced the battery and within about 20 minutes the phone became very hot and completely drained the battery. The heat from the battery actually faded the ESN & other info on the tag under the battery.

The manager said that the phone wasn't defective & wouldn't replace it because I had caused the damage, although there was no visable sign of damage other than the minor fading of the tag info under the battery which was caused by the heat.

I have never dropped the phone or subjected it to any kind of abuse. To look at the phone it appears to be brand new.

I had to pay $85.00 deductable on my insurance and I will receive a refurbished phone. Quite a price to pay for 3 weeks of service!
