Fraudulent retention of 50% deposit without designing web page as contracted

I contracted with David Duplessis of Webbweavers and Sundog Media to redesign a web page in January. Upon receiving a basic draft, we agreed that I would not provide the final changes until I had accumulated all aspects. He agreed.

I was ready in December but was e-mailed that he could not get to it until after January. Shortly after that we tried to contact him to no avail. Finally, in early July he sent an e-mail that he will nor refund our deposit nor do the web page because our agreement stated I had to have the information to him within 30 days.

The agreement did not state any timeline on my part, only on his part.
Even if it did, he waived his rights when he extended the timeline.

He blew me off and did not return my $2,000 deposit. I cannot afford to fly across the country to sue him for that amount.
