Non responding rip-off Tx tx

We bought a desk on ebay. He emailed us that if we do not get it in good condition we should refuse it so he can claim it.

The desk was delayed about one month and finally came in damaged condition.
We refused it. And he receive it back. He called me back that he is away in Ca and his mother is sick. He assured me as soon as he returns he will give me a full refund.

Afew weeks later when i called him he was very sorry about it and claimed his mother is in very bad condition and his trip got extended. But he assured me he will refund me. Now four months past and he is not returning calls. But his phone is not disconnected and he has no auctions on ebay.
