Verbal Fraud Internet Ripoff Paper Tiger! Watchout!

I signed up to purchase items sold at Cory Craig's auction online on January 27. I was interested in some items to try to resell, mainly watches. Cory had the two watches listed as CUSTOM ANTIQUE or CUSTOM MADE with a net value of about $23,000 according to the appraisals he had on them. This was just the kind of thing I was looking for.

I called Cory before the auction to make sure his descriptions were correct. I asked him if there was any damage to the gold watch or if there were any markings on the back of the stainless steel watch to indicate a style number. He had advertised both as CUSTOM and I wanted to verify that statement. He said there were no markings nor was there any damage.

Based on these assurances, I signed up for the auction and won the items. When I received the watches, the gold one had some broken rubies and the stainless steel one was a mass-produced (though discontinued) watch. It did indeed, have style numbers on the back and I was able to find it online immediately. I had tried before the auction to find this watch for about 3 hrs, typing in all kinds of words from Cory's description into Google but because the style numbers weren't included in the ad nor was I told of them, I couldn't find the watch online and therefore assumed Cory had told me the truth about it being custom made.

I called Cory immediately and informed him of his misinformation. He tried to put it off on the seller or the appraiser as their fault but in reality, the fault lies with him bc he answered my questions, coming across as knowledgeable of the answers. He told me later that he had not actually looked at either watch. Now he is saying it doesn't matter what he said over the phone, I signed the contract online and so he is not liable for anything.

I had to send the watches back to Cory in order to start a Visa dispute, which they later dropped bc of the contract I signed. They suggested for me to get a lawyer as this was over their heads. Cory is refusing to negotiate with me. He falsely advertised the items and then confirmed his lie over the phone.

He still has the watches and won't send them back unless I send him a check for shipping nor will he refund me any money. I do not want the watches back - they are broken and bogus. The internet contract I signed (I would be glad to give you a copy) says that it is the customers duty to do DUE DILIGENCE before purchasing. I did that when I called Cory personally. He gave me false assurances and said the items were as advertised (Custom) and were unbroken without even looking at them for me. He broke the internet contract I signed when he did this and made it invalid. I bought the items solely based on his verbal assurances, which turned out to be false.

He has told me that "other customers" who haven't liked what they received from him have him resell the items for a 20% fee and he would be happy to resell mine for the same! Talk about a scam! Selling misadvertised items over and over again to get a 20% fee from every person that is scammed!
