She deposited my check of $3000 when our final agreement was $1000 on 12/13

In Dec Ms. Zerushka phoned me to make a settlement of $3000. After mailing her the check on 12/5. A friend told me that the debt was 8 years old and should be canceled. Immediately I phoned her and faxed her about it. Then she suggested a reduced amount of $1000 as a final settlement which I agreed. Meanwhile she deposited the $3000 check. I demanded a refund. She hung up on me everytime and refused to do anything.
