On the morning of February 1, I purchased a motor vehicle tag for an Eclipse which was given to me because someone owned me money. That afternoon I took the car to Mr. Transmission for the free performance check. [I had used Mr. Transmission in the past and was pleased with the work]. I knew the vehicle had transmission problems and wanted to get it fixed. After the free performance check, I agreed to allow then to do the internal inspection for $389. I called the next day to check on the car and was told that they hadn't started the inspection yet.

This went on for two weeks. One day I called and was told that the transmission was pulled and was waiting for inspection, I ask them to call me and let me know what they find. No one ever call (I have caller ID and the call would have be listed). This want on for a few days. I Called again and this time was told that they were trying to locate parts (I was also told by the service manager that parts for this transmission were hard to find) I ask about how much this was going to cost and was told that they would only know after they located the parts, again I ask them to call me with this information, which they never did. My son stopped by the shop (2 times, a week apart) on his way to school and was told they were working on finding parts.

On Tuesday the 22, of February, 21 days after the car was put in the shop I stopped there to find out what was going on and was told by Jonathan, the service manager, that they were still trying to find the parts. I told him that was BS, a National company and they could not tell me the cost of the repairs. Jonathan made some calls then told me it would cost me $1600 for rebuilt parts and labor or $900 for a used transmission plus $425 for the swap-out. [I have this in writing with Jonathan signature) I asked how long this would take and was told they had 30 cars they were working on but my car was on the top of the list and it would take a week to do. I told Jonathan to go head and rebuild the transmission.

After I left I went by Autozone to check on the cost of a rebuilt transmission and was told the cost was $1094 and could have it the next day. I went back to the shop and was talking to Jonathan when Shane Lusk the owner came over. We got into a heated argument about the amount of time this was taking and the fact that no one would call, he said, "you calling Jonathan a liar, " I said, "Jonathan never call, I have caller ID and the call would have showed up on the phone record." Shane said, "You are calling us liars you can take your car and get out." I ask when will it be ready, Shane stated, "when we are dam ready to give it back to you."

I left and found the phone number for Mr. Transmission Corp office. And called their legal department and was ask if I talked to customer service, I told her no; she took my complained and told me she would forward it to customer service. That afternoon a lady from customer service called; I told her my story and she stated that she would contact the local shop. The next day customer service called, and I was told that the car would be ready by Friday.

On Friday I called and was told to call back at 5o'clock. I called and was told the car would not be ready. I called on Monday, Tuesday, and Wednesday and was told the same thing, the car is not ready. I called on Thursday and ask to speak to Jonathan and was told he was out of the office; I ask to speak to Shane and was told he was on the phone. I ask the secretary to have Shane call me. Two hours later I called again; Jonathan was still out of the office and Shane was still on the phone. I told the secretary I was on the way in to pick-up the car.

When I arrived Jonathan told me he would get the car ready. The secretary handed me the repair order which I signed and paid for. Jonathan then came out and informed my son and I that they had damage the differential and they would repair it and take off $150 from my bill and I would have the car by Tuesday (this being a Thursday) or I could try and drive the car or have it towed. I was tired of their bull shit; I told Jonathan I would take the car. (I have AAA plus which covers free towing if I did break down)

When I got into the car to drive; I notice that the alternator light was on and drove to the nearest auto parts store to check out the problem. Both battery cables were loose; I purchase an adjustable wrench and tighten the cables. The alternator light stayed on. I turned the engine off; to check the alternator connection, it was ok. I tried restarting the engine; it was dead, dead. I had the parts store check the battery with their tester it was dead. I purchased a new battery and the alternator light went out. The shop knew for a week that the car was going; you would think someone would have put the battery on charge.

This morning, 35 days after the car went into the shop it's sitting in my driveway. This morning I also called Jonathan and told him I got home ok and ask him it he noticed the alt light being on; he said, "I didn't pay any attention" and I told him the battery cables
were loose and was he going to credit my account the $150 for the damaged to the differential. He told me, "I can't do that but I will check with Shane."

On Monday I will check with an attorney friend of mine to see what civil and/or legal recourse I have.

I guess you are wondering why I am keeping you in the loop; read on. I picked up the car yesterday from a local shop after being there 24 hours. There was no damage to the differential, the transaxle (transmission) housing had a groove cut into the side from a loose bearing and one CV joint was bad. So why did the car stay in the shop for 35 days waiting for parts too rebuild the transaxle when the housing was not useable? I ask the mechanic, did the transmission look like it had been worked on? His reply was, There was four (4) bolts missing and the rest of the bolts where lose, the whole transaxle was lose.

I guess if the transaxle fell out during my 40 mile trip home and I was killed the shop would have been charge with murder or at least neglected homicide. Of cause I can not prove that your independent shop had in fact left the bolts out and the others lose. So now not only do you have a very dissatisfied customer; you now have a very angry piss off former Marine Staff Sergeant.

I am turning over my whole file to the Athens/Clark County District Attorney for their information and education.

I would think by now you would have discussed this whole matter with the legal department. I can not tell you what to do but I would think it would be in the best interest of Moran Industries (Mr. Transmission) to send your own undercover investigator to this shop to see what the hell is going on.
