Recently I had the opportunity to deal with Ira from Feel Good Watches.com m

I emailed this question:

How much for the Patek 5054 listed on your site and would you take a new Patek 5022 in trade?

So I called Ira: gave him all my order info. Then I was told the watch was $19,500 and he made a mistake. Ira convinced me the watch was MINT.

So I ordered the watch. This was my first mistake, once he switched up on the pricing I should have walked away. To be fair he said the reason for his quote error was: rose gold versus yellow gold.

I got the watch the next day and it looked good. However he charged me 4% for using my AMEX card or $780 more. This is 100% not kosher with any credit card company and grounds for terminating a companies merchant agreement.

After one week I had an occassion to wear the watch for the day and noticed it ran slow.
So I timed the watch the following day and found it lost almost 4 minutes per day. Due to an extended business trip out of state I wasn't able to take it to my watch maker for another 10 days.

My watch maker found the watch to be dry and it had glue holding a jewel in place.

I emailed and faxed Ira the following:

Dear Ira,

I am not happy with my purchase of the Patek 5054.

First you quoted me: $18,000 for the watch.

When I ordered it: the price jumped to $19,500

Then I got the watch with the bill and was charged 4% for using my American Express ($780) This practices violates the merchant agreements for all credit card companies policies and procedures.

The watch was advertised and described as: "pre-owned and in MINT condition".

The watch however is near mint condition and does not run properly. It loses 4 minutes per day. There for I took the watch to Swiss Time (Claude) in Portland, Maine for examination. Www.myswisstime.com 207-773-0997

Claude examined the Patek and found the watch to be dry and not serviced in several years. (or not serviced properly.)

I am not comfortable with sending you the watch back for service based on your flip flopping pricing and sending me a watch in poor condition. There for I am requesting to send you back the watch for a full refund. I need an answer quickly as I have left the watch at Swiss Time and will have it overhauled there if I am forced to keep the watch. At which point I would seek an alternative method of being made whole by you.

I then got serveral calls from Ira. I emailed him and told him I wanted to do everything in writting as he had flip flopped so much verbally I needed to cover myself.

After several more calls, Ira left me a message and said: my watch maker was a crook, that I was a poor execuse for a business man and he cursed my Lord and Saviour; Jesus Christ. Ira ended the message by telling me he would give me another watch, another model, whatever he could do to make me happy.

Now mind you I have the actual message saved and can post it online for proof.
Then I emailed him this:

Ira:

I will send the watch back to you.
I do not want this watch as it is not MINT.
If you are going to replace the watch: I will have it look at by Patek in NYC, as I travel there 4 times a month. This is not what I desire - I want a refund and to go our separate ways.

If you have a yellow gold watch in stock for the $18k as promised, that will work.

The watch will be shipped out DHL insured Monday.

I do not want this watch back - it is not what you represented to me.
And yes I prefer written communication with you versus phone calls, then there can be
zero mis-communication.

I will have your watch fixed and returned — in fine working order

The watch was bought the 3rd of April - there was a 3 day return policy for any reason

Unfortunately — 3 weeks is longer than our return policy

Remember his voicemail message not even 2 hours earlier in the day promising to exchange the watch for any model or other 5054!!!

So my reply to him was:

So much for your message -

You said: I will get you a new watch or another model
Why say it if you don't mean it?

Ira writes back:

Please call

After I told him atleast 4 times that I prefer written communication from here on forward only.
What ever happened to the customer being right or the seller having honesty?
