Brad Eggsware
Admitted Police Attacke

Miscellaneous

A teen admitted Monday he attacked a Tupper Lake Village Police officer outside a St. Patrick's Day underage-drinking party last year.

Brad Eggsware, 19, of Tupper Lake pleaded guilty to second-degree assault as a second-felony offender and could get seven years in state prison when sentencing takes place on April 16.

Officer Jason Amell was attempting to serve a warrant on Eggsware on March 17 after seeing him on Main Street about 11 P.M.

As Amell approached him, Eggsware hit Amell in the face.
A crowd of young people at an underage-drinking party tried to interfere with the arrest and allowed Eggsware to run away.

The officer chased him, but Eggsware tackled Amell and repeatedly kicked and punched him in the face.

Eggsware then lifted the officer's head and shoulders up and slammed him into the pavement several times.

Others from the party joined in beating Amell until more police arrived.

Five others were charged in the incident, which left Amell with a broken nose and facial cuts.

Eggsware then fled to Plattsburgh, where he was arrested two days later.

? This case took on a life of its own,? Said District Attorney Derek Champagne, adding that the guilty plea will help close a festering wound in the community.

? Due to the intoxication of the witnesses and the criminal histories of a number of people involved and the outrage of the general public in Tupper Lake of the actions of these individuals, we feel the plea agreement resolves this matter,? He said.

Amell is back on the job? And continues to deal with the situation, a very traumatic situation,? Champagne said.

The DA said the plea also allows the Police Department to move on under its new chief? And continue to do the fine job they do.?

The plea came just as jury selection for Eggsware's trial was beginning in another Franklin County courtroom.

Eggsware, who arrived handcuffed and shackled at the ankles, smiled, laughed and flashed hand signals to family members in the gallery.

He was warned by court officers twice to stop turning around or he would be removed from court.

He answered questions from County Court Judge Robert G. Main in a loud, clear voice as he stood with his defense attorney, Lillian Anderson-Duffy.

A second person involved in the case also pleaded guilty Monday.
Megan Whitley, 19, admitted she helped blocked Amell's attempt to arrest Eggsware and helped Eggsware break free from the officer.

She pleaded guilty to second-degree obstruction of governmental administration and third-degree hindering prosecution.

But because she has served nearly a year in County Jail and the maximum sentenced for her crimes is the same period of incarceration, she may be released with time served when she is sentenced April 16.

Among the other defendants in his case are Heather Cote, 29; Eric Whitley, 17; Tyrel Martin, 17; and an unidentified 15-year-old.
Eggsware is already serving two consecutive two-to-four-year state-prison terms on a burglary conviction.

Champagne said this conviction will keep him in prison until at least 2012
