Police Fail to give drunk driver a ticket and now my family suffers ripoff

On August 24th, my husband was hit by a drunk driver who then took off. My husband and I ran after her on foot, so she pulled over; when going back to our car to get the insurance info and call the police dept, she took off again; he started up his car and drove behind her trying to get the plate number to report to the police. She then threw her car in to reverse and backed into him; HARD.

His truck is totalled; he was knocked unconcious. The womans son came running up from a bar yelling at her that she was going to get another DUI and he couldnt bail her out this time. The cops showed up and she took off on foot. One cop caught her and yelled that she was lucky she wasnt going to jail. The EMT took my husband to the ER where he stayed for two days; he suffered a pretty bad concussion and bruised his knees up terribly.

The woman didnt get a ticket. The cops didnt question myself or any witnesses. They asked him what happened and he said he didnt remember. They wouldnt take my statement. They took the drunk drivers statement and she told them that he hit her. No report was made of the first hit and run.

We lost days at work, and our second vehicle. I now take the bus. I called a lawyer and picked up the police report to bring to them. The report says that according to her she was hit from behind. The lawyer says we have no case. I'm infuriated because we have many many witnesses stating that she hit him, twice, and that she was very very drunk. Now her insurance company is after ours. I'm not really certain what our next step should be.
