Auto ripoff Fraud misrepresentation of a Certified Pre-Owned vehicle

In January of this year, I purchased what was claimed to be a Certified Pre-Owned 2005 Mustang from Metro Ford in Miami, Florida. I was ensured that the car had been thoroughly checked.

Upon my first inspection it looked fine. However, I was not provided with a vehicle history report.in retrospect, I realize that this should have been a wakeup call.

Within the first week of owning the car, I noticed several problems, which, although not mechanical, were definite signs that this car had not been through a 115 point inspection. Below is a list of the problems I found within the first week:

The passenger side seat track was fused and unable to be moved.
There were missing parts.
I noticed small amounts of rust on the brakes.

In the next few weeks, I noticed that the bolt for the spare tire had punched through the corkboard in the trunk. Apparently, this car had parts missing from the spare tire, which caused this problem to occur.

When I brought the car in for service at the Ford dealership in Pompano Beach, Florida, I was advised that this vehicle was a flood vehicle. The reason the passenger side seat track was fused was due to the fact that it had rusted together.

I was never informed that this was a flood vehicle and in fact, the original ad for the car (which was on the internet) stated that it had options which it in fact, did not.

I spoke to the salesman repeatedly (Jose Rojas) and he informed me that the part which I needed for the trunk was not available. I was sure that this was not the case. I proceeded to drive down to Miami and speak with his supervisor and was told they wouldn't be ordering the parts.

After some conversation, I was able to persuade him to order the parts for me. However, weeks later, I was still awaiting these parts (which were supposed to have been sent via FedEx). More parts have broken in the last few weeks.

I recently was informed that certified pre-owned vehicles must undergo the 115 point inspection process and cannot have any issues relating to hail, flood, or accident damage. I feel that I was cheated in my purchase. I have called Ford's customer service center and I am currently waiting to hear from a Ford representative.

I will be asking for a new replacement, due to Metro Ford's gross misrepresentation. If the dealership refuses to comply, I will be filing litigation against them.
