Breech of Contract

I relocated to New Orleans in March came upon ShadowLake Villas twice and after the friendly, warm greeting I decided I would enjoy living here.

I moved in on April 11th and it's been nothing but a living nightmare. The people above me have been extremely inconsiderate about noise - I knocked on their door twice and the second time the wife was very indignant with me stating she's going to keep letting her animals play and didn't care that she was disturbing anyone.

I made numerous complaints, infact on a weekly basis starting in April through the present day (8/6/05).in addition to phone calls, I went to the leasing office and have talked to all the leasing consultants - they would call the people and instead of it getting quiet, they would purposefully start stomping around, bouncing balls, they have 2 dogs which they allow to play at all times and it sounds like a herd of horses.

I have not been able to get a good night sleep because I'm awaken at all hours in the morning. I deal with enough stress from work and when I come home I should not have to put up with inconsiderate people every single day.

In fact, I spoke to the Dana who is the Manager concerning this situation and was told to start calling and having the courtesy patrol come by, to write her a letter so that they can have this documented because the people over me have broken their lease but guess what - nothing has been done.

As you can guess I can't take it any longer, I gave a notice after only living here for almost 5 months out of a 1 year lease yet they still expect me to pay them $1,520 despite the fact they did nothing to rectify this situation.

In fact, I found out that a tenant in LA has a right to cancel a lease when the Landlord fails to maintain a tenant in a peaceable possession and it may also give rise to a negligence claim if the landlord has known about the disturbance. Well, I can assure you everyone in the leasing office has been made aware of disturbances yet they act as if dogs have more rights than me a human being.

Please note, I do not fault any of the leasing agents I fault managements lack of action, lack of concern, lack of ability to return phone calls and follow-up and provide proper resolution.

It's sad that the management took no action, allowed the matter to get progressively worse and want me to pay for something due to their neglience.
