Miscellaneous

I was contacted by a sales representative from Access Travel Network (ATN) about some RCI extra weeks. She kept leaving voice messages. Finally, I called back and the sales associate stated that I had 12 RCI extra vacation getaway weeks available to rent out. She stated that the 12 RCI extra vacation weeks are available to either give to friends and family or that I could rent them out myself. I told the sales associate that I was not interested. However, she convinced me that I need not do anything, that they have a lot of corporate clients that will rent the weeks from me very quickly. She mentioned that they had very few weeks to rent out to their corporate clients that once I allow them to represent me they will get it rented out quickly. All that was required from me was an up-front fee to activate those weeks (about $149 per week for a total of $1788 which I paid with a credit card). I was told that the sales representative would have my unit rented in 90 days, although the guarantee is 180 days. They guaranteed $1260 per week for the unit. I was also given a guarantee that I would have a 180 day turn around of my return money with extra, but I never knew the contract does not reflect the guarantee. I had recently purchased the property, and as I had never owned this type of property, was not aware of the perks. However, she took me to RCI site showing me the extra get away weeks to convince me. I argued with her but foolishly I gave in thinking I would be able to at least get my money back no matter what happens.

What I never knew was that the get-away weeks they were showing me requires RCI members to pay the full amount for rentals before they become available to them and not just $149.in order to convince me, she gave me her personal house address and personal telephone number which I probably don't have now.

After about 80 days of getting me to type my name on the contract (Contract #ATN - 3449) on 26/9, a representative from the company called to say that the weeks had been rented out and all that is required from me is to pay them the tax and the cheque will be mailed out to me. At this point, I suspected it has to be fraud. I therefore called my credit card company to see if I could get my refund back. I was told that unless I could prove that it was a fraud there is nothing that could be done since I authorized the withdrawal from my card. That same day that I received the call about my rented weeks, I also got a voice mail from one of their representative stating that I should give them a call to discuss the status of my rental. The sales representative also mentioned in that call that on no account should I pay any additional money to any agent claiming to be from them that their charge is a one time payment. I became more curious about the coincidence and thereafter I contacted the company themselves to see the status of my account but never got anyone to talk to. About 10 days after I finally got someone who told me the guarantee was 180 days and not 90 days. I asked the sales representative, how come for more than 90 days they had not rented out even 1 week. They had no explanation and at this point I just wanted to wait till 180 days before taking the next action. However, a few days ago, someone claiming to be from Access Travel Network called my wife to indicate that the weeks had been rented out and all we need to do to get the cheque is to pay the tax. I never responded to them this time because of my initial experience. Afterwards, I just decided to call Orange Lake whom I bought the timeshare from. I was told categorically that it was a fraud and they advised that I contact the Florida department of Agriculture to register a complaint. After doing that, I also called ACN to demand a refund but I was told they had not been able to rent the weeks out. At this point I told them they lied since I do not have 12 weeks to rent out. They told me it was true. I contacted RCI and was told it's not true

I want my full refund because the contract was all based on lies. I called RCI who they claim are the ones who made the extra vacation get-away weeks available to members and RCI categorically told me that it was a scam and that I should contact better business bureau. They told me the extra vacation get-away weeks are available to members who want to pay the full amount of rental. It is available to help members who want to use more than their timeshare weeks for vacation but they are required to pay the full amount which is not fixed but depends on time of year, number of bedrooms, location, and other things. Consequently, Access Travel Network which fraudulently collects about $149/week for rental irrespective of the number of bedrooms misrepresented what the get-away weeks are meant for and the cost.
