Hidden charges

My husband purchased a single download for $1.99 (or so he thought) from this web site for some technical information he needed-however he never rec'd the confirmation or information allowing access to this download. But they have promptly charged the debit card for the $1.99 an additional $4.87 for "options" and an addtional $39.95 and an additional $41. Xx -so he asked me to check into this issue.

Please note I have done several[/U] searches for info on validity & safety of this site, THAT I THOUGHT SHOULD BE SHARED. HOPEFULLY OTHERS WOULD HAVE READ THE TERMS & CONDITIONS PRIOR TO PURCHASE - WOULD NOTE THE RIDICULOUS-NESS OF THEM AS RED FLAGS (my husband did not) but I found other complaints noted on a variety of sites indicate others may have also fallen prey to this site. SO here's what my research has found thus far

McAfee Site Advisor notes: for this IP THERE ARE ALSO 26 OTHER MATCHES FOUND FOR 62.213.100. And "WARNING: The IP PTR associated with this record, does not resolve back to it's original IP address. This is very bad practice. Original: 62.213.100.3 PTR IP: Failed to resolve"

And www.malwareurl.com [/U]search results in OVER 715 [/B][/U]results for the nowdownload.com site - Page one alone (LISTED APPROX 50-60 OF THESE) for this notes numerous "leads to exploits" (of credit card info) as well as notations linking this site with the "BACKDOOR-Poison, and TROJANS-Key-Logger, Agent, TDSS, Wimpixo, &OnLineGames, also numerous notations for "traffic direction for Rogue antivirus". (that was enough for me I didn't even go to page 2)

Their (NOW DOWNLOAD.com) T&C (term&cond) note[/U][/B] that "The following OPTIONS [/U][/B]are ADDED [/U][/B]to the standard membership package BY DEFAULT[/U][/B]:

1. Lifetime Full & Unlimited Access (26.65 USD)

2. Blazing Fast Downloads. You will get Free Updates & New releases all files which we will add in our system. This option costs 0.11 USD a day and the user is subscribed to this option for one year (39.95 USD).

3.1 month subscription to PrivacyRescue.com (*SEE OTHER NOTE BELOW RE: THIS SITE)[/I]- an additional service that ensures 100% privacy protection during any online activities (39.95 USD)."

*RESULTING IN YOUR $1.99 download purchase ACTUAL END COST: "The total cost of this package is 106.55 USD."!!!

"In order to reject additional options, products and special promotions you must explicitly indicate your incompliance (uncheck the appropriate checkboxes."..."before submitting your credit card details[/U][/B]." AND FURTHERMORE: "Also note that by signing up for additional options and products provided by download-gate.com you agree to check workabilityfunctionality of these options and services and participate in special promotions provided by download-gate.com[/B]"

(maybe since this site originates in Russia they pressume ordering that you must have ANY activity with any other site -disregarding your wishes and preferences over how u chose to use ur time is kosher??!??)[/I] AND

Regarding info you're paying for and their warranty:

Does have its own laws (in civil & commercial codes) on express & implied warranties for any products or services purchased in calif (internet or otherwise) which i think may quelsh their attempt to evade this consumer protection - other states may have similar provisions/codes. AND THEY ADVISE THEIR SITE "cannot and does not guarantee or warrant that files available for downloading through this site will be free of infection, viruses, worms, or other code that manifests contaminating or destructive properties." (that's probably your clue to expect some nasty tag alongs with any/many of the downloads they hook u up with) [/I]

And IF YOU WANT TO CANCEL "does not accept requests to close account by telephone, e-mail or in any other way (OTHER THAN IN WRITING)" AND THAT "Note that if you request account cancellation or closure, you must understand that the process cannot be reversed and download-gate.com is not responsible for any data andor money loss caused by closure of your account as well as for recovering closed accounts."

*my note: i have yet to find a mailing address for them in order to submit cancellation[/i]ie. You can cancel -but that only prohibits you from any further access[/u]- it does - not - allow for a-n-y refund of any fees. {which is the same information provided when i called their 888-448-6880 number provided with the charge on our account.}

THEY FURTHER CLARIFY THIS BY STATING "A user's sole and exclusive remedy for dissatisfaction with this site is to stop using the site."

SO in my opinion all in all any interaction with this site is dicey at best-there must be other sources -if the info you are searching for is truly available to the general public, I would try to find them - but remember to BEWARE of the 26 other sites that really seem to point back to this site.
