Ebay kept payment but didn't ship items ripoff

James Horan sold me an authentic Tiffany toggle necklace & bracelet for $157.00 I purchased for my girlfriends birthday.

After 2 weeks passed, I emailed and Melin replie give it til' Friday. That week I received a certified letter form James Horan (Jim) apologizing for any delay, and he will ship soon. 2 weeks later he emailed his supplier didn't come through, and apologized for messing up the birthday gift but he may get some in a week later. He said (and I have his email) "we had to refund several people". He began arefund to me through paypal. I was dissapointed (1/2 as much as my girlfriend for not eceiveing the jewelry) but I thought I'll get my refund. After he made it clear hecouldn't deliver, I purchased a similar set of the same make jewelry from another seller (I have the receipt) for $212.00

All of a sudden James Horan cancells my refund, and lies to paypal giving them the tracking number from the certified apology letter he sent me (in my possession) saying this tracking number proves he delivered me something. I have a postmaster report verifying the certifed letter weighing 1 oz. And no parcel by Jim. He later emailed me saying he didn't doubt he didn't ship, but had to make sure before he refunded me.

Now he refuses to cooperate with the ebay mediator in which I'm paying the $25.00 fee for. Why would I have proff he didn't ship, buy the same type item for more from someone else, and be willing to pay to get my money back if he delivered? Good question. Maybe because this person has lied, stolen, & refused to cooperate. Beware this shady business and it's scam to defraud by sending you a certified letter delaying a shipment, and using that tracking number to pretend he shipped.

I hope he has the audacity to reply with a lie, and I will post his emails & letter proving he didn't ship.
