Open box item sold as "new"

I requested a bluetooth headset from KM Technology (Pewaukee, WI) through ebay. Them was outlined as "New, in retail package". Ebay identifies a "new" product as: "New: a brandname-new, abandoned, unopened, unchanged product in its unique presentation (where presentation does apply)." The item I obtained was an open-box product. Both obvious, circular stickers on the exterior of the container were eliminated, and two extra stickers within the container that seal the blue-tooth device itself were peeled back. I wrote to KM Technology and questioned why I'd obtained an open-box item in the place of a brand new product. They stated the stickers (four of these, two away from box, and two within the box) should have "dropped down or been peeled back during delivery". Further emails got extremely rude reactions. I requested KM Technology to possibly substitute the system I purchased using the fresh, UNOPENED product they promoted, or return my income. They declined to complete both. If you should be considering investing in a "new" product from KM Technology, buyer beware.
