Shirts Wrong Size & Won't Return!

I ordered 3 size 4X shirts. My husband and I normally wear 3X and 3X is loose on us. The shirts I recieved were so small I can't even get them past my head. I don't know how many sizes smaller they are but I assume all the X shirts are just large and he claims to have shirts up to either 5X or 6X. Then he posts that he does not accept returns because of size. (I wonder why?) I sent several e-mails and he is very short and does not care. This is not right! How can it be legal to send any size shirt regardless of what was ordered and there is nothing I can do because He posted that he won't return on sizing issues?
