Not getting what I'm paying fo

I'm paying for 16mbps internet speed from Charter but what I've been getting is anywhere from 1.7 to 16... Averaging about 9mbps. If I'd wanted the 9mbps I would have ordered the 8mbps package. The speed fluctuates drastically throughout the day. I should be getting consistent speed considering how much I have to pay for it. I've called several times on the issue and they want to blame it on anything and everything they can without taking the responsibility like they should if they weren't being fraudulent. They were even supposed to send a tech out but never did. This should be taken up as a class-action case with the Attorneys General of all states affected.
