I looked at the website at www.supersmartwebprofits.com/websites. Cfm and read the details for applying their service and websites for my business. Toward the bottom of the page was their guarantee which read, "I am so sure that you will love your SuperSmartWebProfits.com website that I am offering an unconditional 100% money-back guarantee.
If you are not completely satisfied with your purchase, simply notify me within 30 days and I will refund your money, in full, with absolutely no questions asked!
That's 30 FULL DAYS to put our sites to the test - all the risk is on me. I don't think I could be any fairer than that! Improve your business and send your profits soaring with our exciting websites or get your money back!" Below this there's a digital signature from the owner Dustin Griffin.

I thought this was pretty straight forward. It plainly says 30 full days to try the sites. Since they told me they don't offer customers the chance to try the service before they pay like other competing companies, I had to pay first ($3700) and do the trial before I could do real world tests to see if it suits my business.

After negotiating a price with them, they sent an email On Feb 20th at 10:43P.M. With an order form attached. It said to sign and fax the document back and I would be receiving additional setup sheets. I was then supposed to complete those setup sheets, fax them back and it would take an additional 1-3 days to have the sites up and running. After receiving another email telling me I was taking too long and they might retract the price we negotiated, I had to pay right away.

I paid via PayPal on Feb 23rd 2009 at 5pm. At 5:06pm I received an email from their billing dept. With four setup sheets saying it's Mandatory to complete some of them before receiving the product. I thought no problem, I'll fill them out and send them back within 15 minutes. After opening their setup documents I found out I had to acquire four domain names (one for each site I ordered) before I could receive the product. I was not expecting this because not one person from their company told me. I knew this was going to take some time because domain names are extremely important for optimizing the sites to get high up on Google. So I began researching popular keywords and the amount of traffic they would bring.

After about 3 or 4 days of researching domain names I called and spoke with a lady named Mary to ask if I was "on the clock" for the 30 day trial.

She said, "Absolutely not. You're time doesn't start until your sites are Live. You've already paid so your price is locked in." This made sense to me because of the guarantee on their website (which is regulated by the FTC) which stated I could try the sites for 30 days.

As soon as I obtained my four domain names I sent them in to the company. I received the product on March 9th. This was the first day I could try the sites. I put on my calendar April 9th for a deadline on the SuperSmart sites trial. I knew by March 25th that it wasn't going to work for my business. The back office was nowhere near what that claimed it was capable of doing. They would have to revamp their entire product to get it to a point where it would be worth it for us.

I called Mary and asked for my refund. She informed me that I was past my trial period. When I asked her what she meant she told me it was 30 days from when I paid. I reminder her of our conversation where she assured me I was not on the clock for my trial. She said that she thought I was talking about on the clock for the monthly fees. This isn't true. I then spoke to Mike Barnes and he told me to fax in the request for a refund.

I faxed this to them on April 1st and didn't receive a response until April 7th. This is when the owner Dustin Griffin called me. He was extremely rude and obnoxious. He told me I signed his order form which says no refunds after 30 days from purchase. I explained to him that the purchase wasn't completed until March 9th. He told me that I paid on Feb 23rd so that's when the trial started. After explaining the conversation I had with Mary and the fact that I understood this 30 day trial to mean 30 days to try the sites as it mentions on his website, he just kept saying I signed his order form. He got so upset that he hung up on me and called back 5 minutes later and apologized. He said he needed to calm down.

I am in disbelief that I am speaking direct with the owner of a company and he is this unreasonable. I was entirely under the impression that I had 30 days from when I received the product to return it. Mr. Griffin is claiming I called in 2 days too late and his order form says no refunds past 30 days from purchase. I've asked him what his official return policy is because his website says 100% money back and 30 Full Days to try the sites. His order form says there will be a 5% restocking fee and 30 days from purchase. He would not comment on this.
I then told him at the very least there's a gray area in his policy. He should remedy this and just refund my money. He told me there is no gray area despite all the facts I've just mentioned.

Meanwhile, a couple days after he said there's no gray area in his return policy, he changed the policy on his website. He took off 100% Money Back. He also change 30 full days to try the site to 30 days from purchase. If he really believed there was no gray area then why would he change his site? (I don't believe his site has been changed since 2006 because there's an offer on it which expires then.)

I have no idea why a business owner would want to ruin a relationship with a customer and basically demand that the customer stay on with his services. Mr. Griffin would rather keep a customer's $3700 than have positive word of mouth about his company.

When I found out he changed his website because of this, I thought this was a definite acknowledgment of a gray area in his return policy. So I requested a refund through PayPal. Mr. Griffin promptly emailed me back telling me, "Please cease and desist from harassing us about this issue and close this case."... in response to me asking for a refund?

I hope Mr. Griffin and his company can have a change of heart on this. I'd like a refund as promissed by his website, his billing department and per his contract.
