Never sent product, repeatedly claimed it was "shipping today"

I ordered a hard drive from their site on April 1st, using their free 3 day UPS ground shipping. 10 days later, when the drive had not arrived, I called, and a man told me it had been out of stock, and had just arrived, and would ship out that day. 4 days later, I received this email

"Dear Customer,
You has placed the order for two weeks, and we have the product now. Sorry about taking so long. We'd like to cinfirm that you still want the order proceed? Thank you
Customer Service support@memorylabs.com"

I responded with an email saying I was very disappointed in the service, and would like to see some sort of discount/compensation for my trouble, as the company that I'd hired to salvage data off of the old failed hard drive had been waiting on the drive and I had been waiting desperately for the information they'd retrieved. I received no response.

I called and the same man told me it was shipping that day. When I asked about a discount for the trouble and the fact that I'd never been contacted to say the item was out of stock, and it wasn't displayed anywhere on the site. This is what IS displayed on the site:

"For items that are not in stock, we will notify you by e-mail. We will provide you with estimated time of arrival (ETA dates) for any backordered products or offer you another in stock similar part for replacement."

The man told me he was not authorized to offer any discount. I told him I'd like to speak to a manager. He put me on hold, then came back saying "she says she disagrees." I said I'd like to speak directly with her then and he literally said, "she's on the phone, and then she's unavailable." So I asked him to refund my money and I'd take my order elsewhere. He then hung up on me, and I haven't seen a refund posted yet.
