I was looking for a reputable web programmer in my area to build my website.

I found out about Kevin Murphy who works his day job with Wilson Learning, a reputable company. I was under the impression that Wilson Learning provides services for educational websites, which is what my site would be. Kevin said that he would be interested in working on the side to do my website with his personal company Statiksoft. He told me that he helped build Wilson Learning's website and that he was very qualified to do mine. He also told me that he works with several other programmers that do the "front end " work and he named one person specifically - I will call him "John".

He said that he had been speaking with "John" about building my site and Kevin sent me to "John's" website to look at his pristine portfolio.

I signed the contract and gave Kevin $3,650.00 as a deposit with a payment plan to pay the balance. Kevin and his brother Elliot were supposed to have a meeting with me to launch the whole plan for the building of the site and fill me in on what to expect and where to send my document files, etc, etc. That never happened.

After about 30 days, I contacted them, they didn't have "time" to finish the conversation or give me any physical proof that any work had been done.
After another couple of weeks, I called again and still they weren't receptive to my inquiries and refused to show proof of any work.

At that point, I realized that I was being scammed and I began investigating their claims. I called "John" directly and he said he HAD NEVER HEARD of these people or their company until about 4 or 5 days before I called. When I told them that Kevin claimed that he had an established relationship with him about 60 days prior - he was surprised - and he said, absolutely he did not know them at that time.

I went into a contract agreement with Statiksoft under fraudulent and misleading information. I have demanded a refund in full due to their dishonesty and to date they refuse to return my calls or reply in regards to the refund.

I will most likely have to sue them and turn over the evidence to the DA's office in Cocoa of their intent to mislead me.

I won't pursue criminal charges if they give me my refund, otherwise what do you do when dishonest people steal your hard earned money?
