Ripoff Deceptive company advertised on Ubid Auction received destroyed merchandise

Gentlemen:

I have unwittingly become the victim of an incident that may be considered as fraudulent; however, that is not my call.

The Action General Store at Overton, Texas advertised several items on the Internet Auction called Ubid. My wife having been an accountant for thirty years needed a small desk for her office.

We saw a desk offered on Ubid which my wife allowed me to bid on. I bid $279.00 and was informed that I was the high bidder. I paid through a company called PayPal designed to handle this type of transaction. Paid for by Visa.

The total amount was $279.00 plus $45.00 shipping and handling equaling $324.00. The Ubid # 523444598, the date on the sales receipt 3/3/02.

FedEx delivered the desk about 3/15/02. The desk was a total disaster; however, it appeared to have been properly packed.

I took pictures and Emailed them back to Jimmy Warwick at the Action General Store as he had sent them through FedEx; he would have to file a damage report.

I called him and explained that FedEx had picked up the Desk on 3/29/02. He said that he had received the pictures and would refund the total of $324.00.

I called several times and Mr. Warwick assured me each time that as soon as he heard from FedEx he would let me know.

Finally on 6/10/02 I called him and he said he had received a refund of $198.45 plus $45.00 for shipping and handling for a total of $243.45.

He again assured me that he would refund the total amount of $324.00 as he realized that I did not have the merchandise I ordered.

I called him again about two weeks later and Mr. Warwick told me the check would be mailed on the first of the month. I called again two weeks after the first of the month. He told me things were not going to well and he might have to send half at the end of the month and the other half next month.

I continued to call after sufficient time to have received his check, which never came. Each time he assured me that it would be sent.

Finally, his phone at the shop replied that it had been disconnected, next the store phone just beeped as if it was a fax. Since then, no contact no phones available.

I feel that because I live in Arizona and their business is in Texas, especially in a small town like Overton, which I can not even find on the map, he must feel that I have no recourse. My hope is that the Better Business Bureau of Texas might be able to help me solve this problem.
