But you have to agree to the terms of service which no one reads. Then later you find out you are agreeing to them charging you after a 10 day trial $49 per month. And contacting the individual if you can find his email, is almost impossible. And when I told him I never used the service, he said, he didn't care because the terms of service say it doesn' matter.

I say this is FRAUD! The site should tell you up front!
