Mayra Ramirez Never shipped item, Lied, Very little communication on their part

I won an item (eBay item # 120061165107) on eBay, but never received it. I tried resolving this issue by sending several emails to this seller and using the Pay Pal dispute syatem. I have reason to believe that this eBay member is being fraudulent.

After two weeks of not receiving the DVDs I emailed them. They only responded when I submitted a dispute. They said that they "just happened to have" a second set of DVDs and that they would ship it out UPS that very day. I asked for a UPS tracking number and told them to contact the Post Office to see where their original package went. They never responded and would not even tell me what address they shipped the package to.

Since I happen to work at UPS, I know that we guarantee a ground shipment delivered in 3-5 days. 17 days have passed and still nothing. I was checking eBay and I see that my item was re-listed (eBay Item #: 12007213819). Now, it is possible that they had 3 sets of these DVDs, but highly unlikely; especially since they re-listed the product with the exact same item details as the one that they sold to me; specifically "... Like new condition 5 discs. (ony viewed disk 1 once)...".

I also see that the winner of this bid left positive feedback for this seller about 45 minutes after winning the bid. This is possibly the same person (using a different alias) bidding on their own item so that they could raise their feedback or they had a friend bid to do the same thing. I think that this person is just trying to rip people off and never had three sets (maybe not even one set) of DVDs. They are just trying to scam the system.

By raising my dispute to a claim, it will cost me $25 through Pay pal to get back the $48.94 that I paid for the Item. Never bid on any items from this person, they lied, stole, and were trying to stall me so that too much time would pass and I wouldn't be able to retrieve my money.
