Membership sales fraud: lied to by sales people

On May 7, I signed up for a membership of $34.99 ($5 for towel service) per month with LA fitness at Pasadena, CA. I was told that there was only one type of membership of $34.99 per month that allowed me to access all LA fitness clubs (multi-club membership) even though I specifically asked for a membership just for the Pasadena Club.

On Feb 26, I found out that there was the one-club only membership of $ 29.99 per month and I was lied to by the saleswoman on May 7. The saleswoman no longer worked at the Pasadena club. I complained and demanded a change in my membership to a salesperson "David Cruz" in the LA fitness Pasadena. He refused to downgrade my membership to $29.99. I then talked to a general manager "Andrew Giardino" and he agreed to downgrade my membership to $29.99 ($5 for towel service) per month but refused to refund extra fees I had been charged since May 7 for the multi-club membership.

On Feb 27, I received a call from "David Cruz". Cruz apologized for the unpleasant experience I had with the Pasadena club on the previous day. For an apology, he offered a deal that if I terminated the existing membership, he would offer new memberships that allowed both me and my husband to access all LA fitness clubs at $29.99 per month per person with no extra fee (no initiation and processing fees) and promised to return the last month fee ($39.99) I had paid when I sign up for the membership on May 7.

On Feb 28, I accepted the deal offered by Cruz and I was assured by Cruz that he terminated the old membership and issued a new membership and all receipts for theses transactions would be emailed at me and he was not able to provide me any hard copies of receipts at the site.

On April 1, my credit card statement shows that the last month fee promised by Cruz was never returned and I had been charged for the old and new memberships in May and April. Cruz never terminated my old membership but conducted a fraudulent act to sell me another membership. He no longer works at the Pasadena Club. I complained an operations manager "Cindy Ramos" who promised me for the refund of fees for May and April but refused to refund the last month fee. She told me that only $34.99 of $39.99 the last month fee would be credited in my LA fitness account and also said that the balance of $5 could be neither credited nor refunded.

On April 2, I received an automatic email of cancelation of the old membership stating "We received a request to cancel your fitness membership. Your last billing date will be on 4/1. Expiration of your membership will be on 4/01 and includes the last month pre-paid dues."

As of today, I am not aware of any refunds or credit in my credit or membership accounts.
