At&t refused to replace my defective motorola c139 cell phone while it was under warrantee

In march i spoke to torian thompson who worked in the at&t president office agreed to replace my defective cell phone with a new flip phone.
When i called at&t president's office to arrange the replacement of my cell phone i was told torian thompson no longer works in the president's office and they refused to replace my phone
i also made an attempt while my phone was under warrantee to return the phone to at&t wireless in deer park, ny and they also refused to replace my phone.
At&t violates the warrantee of durability act as well as the unfair and decptive practices act by refusing to replace my phone.

The warrantee of durability act states that even if the warrantee on the phone has expired that the company has a duty of care to replace the defective item if the item has not reached the threshold of durability within a certain period of time.
That means if the life expectancy of the phone is 5 years and the manufacturer warrantee of 1 year expired the company selling the phone still has an obligation to replace the defective item.
