Fraudulent charges to my credit card by virgin mobile warren

Hello,
This is in regards to Virgin Mobile charging my credit card fraudulently and without my consent.

On July 22 I received a text message on my virgin phone stating to TOP UP before midnight or my phone would auto-Top UP using my credit card. When I received this text I called Virgin Mobile and informed that I do not want my credit card charged and do NOT automatically charge me credit card (MC) the representative said that she would note the account and my card would not be charged. I knew I had a balance of $5.08 still on my account.

The next day after I called July 23 I had a heart attack and was in the ICU at St Luke's Hospital in my hometown I was discharged on July 25th. When I got home I checked my balance and realized that Virgin Mobile went ahead and auto Top UP when I specifically asked them not to my credit card was charged $62.98. I have NEVER in the 5 years that I have been with Virgin Mobile ever paid that amount EVER!!! When I called Virgin Mobile on July 24th to let them know what happened and asked that the charge be refunded back to my account I was told that they were unable to do so even though the investigated the situation he then (Richard the supervisor) determined and ADMITTED IT WAS THEIR FAULT. But could not refund back to credit card, he said that I had used too many mins.

I advised him that I was using the phone based on the $5.08 balance I had on the acct and was UNAWARE that they charged my account until I checked my balance. He then stated that there was still nothing that he could do and again admitted their error and asked if I wanted a $40.00 bonus to my plan, for which I declined. I want my refund credited to my account asap, since this was no error on my part and I don't have that kind of money for this company to make mistakes on. I will take whatever legal steps needed to ensure that my acct is refunded, for I definitely feel that this was fraud by Virgin Mobile.

Also looking back through the 5 years that I have been a customer I have never had Auto Top UP, which is why i don't understand why they did this. I need this matter resolved as quickly as possible, and because I have been a VIP customer with Virgin Mobile I don't want to file legal charges against Virgin Mobile But I will if this is not resolved in a professional and timely manner.
