Will not refund money deposited for merchandise

I was working with Tweeter (Montgomeryville Mall, PA) in September to have a TV installed over our fireplace and install surround sound, etc. They worked up a quote for the TV and the installation and asked for 20% down to hold the merchandise and schedule a date for installation. We had the install tentatively scheduled for 11/11 and all was in order pending me putting money down. The total bill was approximately 7,000 for everything.

On October 18th I decided to put down more than the 20% because I had the cash available and wanted to pay a smaller balance due at the end of the process. I wrote a check to tweeter for $2500.00 that day and all appeared to be ok.

On October 31st I got a call from my sales person saying there were rumblings the company was going bk, and he didnt recommend proceeding with the installation, and that he would get my money refunded to me asap. He then advised me on Nov 1st that they cut refund checks on Tuesdays which would have been Nov 4th and I would have my check shortly after that.

2 weeks later, i still didnt have my refund. I called him to find out what was up and he told me all Tweeters accounts were frozen, and there was nothing he could help me with to get this money back and to get an attorney because the bk is going through. To say I was livid is an understatement.

Bottom line is that now i have to petition the courts as a creditor to get MY money, and who knows how long that will take, not to mention the grief, or if I will ever get it at all! To me, this 2500.00 was never their money to begin with. It was simply used to "hold" merchandise... How a court can order how deposit money is not my money is beyond me.

Also, the courts have allowed gift cards to be used until the stores liquidate, which is supposed to be completed by December... The stores can remain open and sell millions of dollar worth of merchandise, but I cant get my $2500.00 refunded? I would be willing to accept merchandise if necessary, and I dont see how my deposit is much different than a gift card! Where do we live, the Soviet Union that my money can be stolen from me this way? A court has no business allowing my money to be used in someone elses mess like this.

We are not made of money, and this $2500.00 in the hands of Tweeter really annoys me. With the holidays coming up, I hope the courts and whoever else is deciding what to do with my money choke on it.
