(ebay id: wmcellphone co. Cellular hong kong) Bought Cell phone on ebay Nov 26 from them. Recieved phone (screen was cracked) They said I had to pay for shipping back to Hong Kong (addtl $50) to get a new replacement phone. Sent it off 12.6.2007. They said they would not send another phone until they receive that one back. Received replacement phone around 12.16.07. Arrived and was a used/refurbished phone with the lcd screen wobbly and several scratches.

I emailed informing they needed to replace it. That I paid for a NEW phone not a USED phone. They told me to send it back and again another $50 for shipping we had to pay. Sent off around 12.20.07. Constant emails & trying to get a hold of them after we sent off this phone and no sign or contact of another phone being sent out. Finally new year 2008 rolled around and no phone had arrived. I emailed and emailed. No response.

Finally they responded on 1.2.08 saying that they have our transaction under investigation and will inform me in a soon on whether they are going to send out another phone. "WHAT"! We paid for a phone. Were they thinking they were going to keep our money and the phone. I mean this whole situation by now was a nightmare. Around 1.12.08 they agree and advise that they are sending out a new phone and that it would take 1.5 to send it out from the manufacturer. We agreed and remained patient and hopeful.

THEN ALL THE WAY UNTIL FEB. 26 No response from them on the status of the phone. So, we decide to confirm they are ignoring our emails by creating an alias email address and persona. Rita Garacci. G_ r at yahoo.com to see if they would respond. And sure enough they did.

Then we respond/reply letting them know that it is US - antake38 the Antakes from EBAy and our purchase situation and they respond saying that they were not receiving our emails and that their email was messed up and that our emails were going into their spam box and that they would not read them or respond.

On 2.17.08 they inform us AGAIN (liars!) that they will inform us on Tuesday on whether they are actually going to send out a new phone. WTF? Huh? We were dumbfound and so upset. HOw could this be happening. 2.19.08 they congratulate us saying their manufacturer agreed to send out a new phone. (WHAT huh.By this time we are seriously waiting and want our phone and this whole ordeal to be done!) They say it will take 5 business days to receive the phone.

MORE THAN 5 bus. Days rolls around and on 2.27.08 they finally respond telling me that the phone isn't there because it actually will take 5-12 business days! (Oh right. Yea right!) We still waited!!! All the while we are sending emails informing them we are going to take action from the US and have contacted our attorneys, ebay and paypal. They respond on 2.28.08 saying to be patient and allow some more time for the phone to arrive.

By 3.10.08 and NO PHONE we are over whelmed and just exhausted with this whole process. And no response from them. We decide to call them. We get them on the phone on 3.17.08 which was a shocker and the gentleman states to be patient they got the phone back (it was sent back to them) and that they sent it out a week prior and that in 5-8 business days it should arrive. We wait. We wait.

We continue to send emails through several email accounts and our ebay account. No response. We inform them constantly about how we are going to file our reports and that we won't give up. We then continue to call them. (costing an addtl 40cent a minute to hong kong). No answers. And keep in mind they are a day ahead and when it is day here it is night there. So, that is a difficult hurdle too. No response. NO returned calleds or emails.

We decided on 3.27.08 to start all our reports and filing against them. Contacting their authorized dealer, ebay paypal, etc. All are informing us its too late to open a claim or dispute. This has cost us alot.including $50 a month for internet on our cell phone bill for int. On the pda phone which we don't have. Not being used because I also had to buy a rinky dink replacement phone to use in the meantime of not having the phone I bought from them. Which costs us an addtl $150.00. PLEASE HELP!

We got them on the phone 3.28.08 and she says Mr. Hui not here leave message. Again today the same thing. They won't deal with me just keep putting us off. I have already done all these. No response still. What are we to do - walk away from all this time, effort, and money! This is not our fault and they get to get away with it?
No one can do anything. This was a scam! And has been a nightmare. We have already contacted all sorts ofcompanies and filed reports.

But because of the timeframe of the whole ordeal (which we could not help. I mean shipping took weeks at a time any way - that ate up all the time/days) we can't get our money back or a response from them.
