Bait and Switch advertising

In the day and age of evryone wanting all kinds of game systems for their kids at Christmas. Kmart is out and about taking advantage of the bait and switch practices.

The ad starting on December 8 had Xbox 360 systems with a package deal. And then offering a $25.00 gift card. There are 3 local stores left in the Colorado Springs area. All were out of stock. I had put a regular Xbox on layaway so my kids would not find it. This happened 10/24. Regular meaing not a package deal.

Two days prior to my layaway transaction the store I was at was completely out of the Xbox that did not come with any games. I called and requested the night of the ad to have the "package deal", held for me. I arrived at the store to find out they had "sold", the last one. The customer service person called the other two locations, but to no avail, neither one had the system either. However, the mall location had what he told the customer service rep a different kind. A Halo addition. The way it was presented to me was that it was a package deal with the Halo game.

I drove to this location. Started the transaction only to find that this system did not contain a game and I could not have it for the price in the ad. The electronics person informed me that the Xbox "package", in the ad had not been in stock for several months, they did not expect to get it in and they were not offering any kind of rain checks. It's a fact that Kmart has had their financial strains. Now they are getting deceptive in their advertising. I believe that several years ago Montgomery Ward got in trouble for this thing called Bait and Switch. Where is Montgomery Ward now?
