Is owner, No Xbox 360, Not refunding money, since ripoff

After a long search for an Xbox 360 I found Alliwire.com (Dillon Millsap's site) had them for sale. The price was good and I had time to order and have it for my son on Christmas morning 2005. I ordered the Xbox 360 on Friday, September 30. I was order # 32 on a list of a few hundred people.

Since paypal was not an option, I obtained a bank check and sent my payment of $416.35 out to Dillon Millsap on 11/03. I anticipated delivery by Christmas as promised.

Soon I received news that Alliwire.com had been scammed for $39,000.00 but... There were 2 other suppliers I was told, and I agreed to wait it out. After all, this was my son's big Christmas gift.

No Xbox 360 had arrived by the end of March. April 1 I emailed Dillon and asked for a refund of $416.35. Dillon asked if I wanted store credit? I said no. April 14 Dillon asked if installment payments would work for me? He offered to pay $50.00 every 2 weeks. I said no.

I am a single mom with bills and obligations that need to be paid. I told him he had my money for 6 months and I needed a full refund. I said I was order #32 on the list and my refund ought to be quicker then those who ordered after me.

Monday, April 17Th I received an email from Dillon that said, "Hello Mary, I'm sending your full refund this week. Got the money in and I will let you know once it is in the mail. Dillon Millsap, Alliwire"

It is now January. I have yet to receive a refund check for $416.35 nor have I received responses to multiple emails and phone calls to Dillon Millsap, Alliwire.com.

It is sad that a parent is unable to fulfill the wishes of their child because of the indifference and unfair dealings of others. All I want is my refund. Dillon has had my $416.35 since November.
