LTD bait and switch! Pocket the difference in price

On 11/10/04 after doing some research to find the lowest price, I ordered a 52 inch JVC TV model HD52Z795 from Inoax LTD for 3199.00, a 5 year in home warranty for 349.00 and an HDMI connection cable for 69.00. A total of 3766.00 was charged to my Visa and American Express cards on 11/10/04.

On 11/19/04 I called to inquire about the status of my order, since I had received no invoice, shipping or tracking info and was told there had been some mistake and shipping had not taken place but received assurance that it would be corrected and shipped immediately.

On 11/22/04 I received email with an invoice (containing all of my credit card numbers and personal information) attached confirming the above order, but no shipping or tracking info.

On 11/24/04 I called again (at no time has this company ever contacted me regarding a problem with my order) to inquire about shipping. I was told that, in fact, the model TV I had ordered and paid for 12 days earlier was not available.

I asked to speak to the store manager and was transfered to "Victor" who proceded to try to sell me all sorts of alternative products (an older model of the same TV which did not have a built in tuner, a tuner, aditional cables, etc). I refused. Victor called again with a matter of minutes and proceded to try again to talk me out of a refund. After the third such call, I reluctantly agreed to accept the older, less expensive model JVC TV (model HD52Z575) which lists on their website for 2279.00, a tuner for 600.00 and a refund of the difference. I requested an updated invoice and shipping info.

On 11/29/04 I had received no further communication from Inoax, so I called again (By the way, it usually took 10 - 20 minutes to get through to someone - they don't answer emails). Now, I am told that the shipment is being held up because the tuner is not compatible with my VOOM satelite providers service. I said "ship me the TV, warranty and HDMI cable and refund the difference".

I finally received tracking information a few days lated but no invoice. After several attempts to reach Victor by phone, I finally was able to speak to him and was told the price of the TV would be 2879.00 (although at no time was I told the price would be different from the advertized price) and I have never received an updated invoice showing this new price.

I told Victor I would not pay more than THEIR advertized price and I would require written confirmation of this before accepting delivery - none was forthcoming. I refused delivery on 12/10/04 and no one from the company has contacted me by any form of communication since that date.

It is now 12/24/04 and I still don't have a refund!
