Mortgage Modification Reported Complete, Then Past Due Payments Demanded

My mortgage was an ARM and I was told to call Chase and arrange for it to be changed to a Fixed rate. The whole process started in March 08.

In May 08 I began a kitchen remodel project and it went overbudget and I fell behind in my payments. I called Chase at least once a week to see if they could do something I was always told the modification had not been resolved and if I was behind, the payments would be put at the end of the loan when the modification was complete.

On August 2,08 I received a call from collections about the past due payments I was told the modification had been completed (July 30,08) and the only change was ARM to Fixed, and I would have to pay the past due or the loan would go into foreclosure. I have spoken to several customer service reps and some of them are as confused as I am, because Chase should have researched the loan before completing the modification, and some have been down right rude and nasty. I am a teacher and I did not plan for the remodel to go overbudget. This whole incident has done severe damage to my credit and Chase doesn't seem to care.
