Fairbanks is a RIPOFF. They bought our origial mortage out. When we were just begining to get caught up on late payments we were only 60 days late when they put us into forclosure and told us we couldn't try to get caught up, they told us we had to pay the whole thing.

They hung on to checks of ours and we thought they were cashing them... But instead sent them back to us saying they haven't got paid and charging us late fees. They would charge us late payments even though we would send payments out 3 weeks before they were due and say they got the payment late. Forcing us to do checks by phone and then charge us for the call.

They make false forbearance promises and do not answer or return calls. They would not let us re-modify our loan when our original mortage company said we could. They also wouldn't call HUD to try and let us get on a Partial Claim loan. We wrote to fairbanks attorney's Adorno and Yoss in Miami, florida asking for a payoff statement and reinstatement figures. We sent the lawyer and fairbanks certified letters asking for these things numerous times and got no response.

I even called them and they said that they would send the information requested out and never did. I could not refinance without a pay-off statement and they would refuse to send it. I thought thye were suppose to send it to me within 10 days from my request. They got a sale date put on our house for Dec. 2 and just sent us the pay-off and reinstatement figures a weekago. That is 2 weeks before the sale date and 5 months from our request. Now I can't get refinanced because it is to close to the sale date, when I could of weeks ago if they would of sent us the payoff instead they let interest and penaltys build up without giving us a chance to save our home.

There has got to be a law against this but we don't know where to turn. If someone knows an attorney or somebody that can help in this situation or knows what the law is in regards to this matter let us know. We would like to start or be part of a class action suit against them and have them stopped from taking peoples homes who are trying to pay and get out of a financial problem. It seems that Fairbanks Capital has more complaints against them then any other company. That goes to show you that they are a rip-off and maybe worse then the crooks that worked at ENRON.
