Fairbanks Capital Corp deceptive rude ripoff

No customer service training if their lives depended on it...

I have had nothing but problems with Fairbanks Capital. It all started last year in April when my loan was sold to them. My checks would never get posted and then they would charge a late fee or I would have to reissue the check.

Next I had to file bankruptcy this was a nightmare. I was all current on my payments; then I recieved a letter in the mail shortly after my bankruptcy hearing saying they are foreclosing on my house. I called the customer service and they would not speak to me and I would have to talk to there BK department after being on hold for hours each day I finally called the customer service department again this time I did not let them transfer me.

They told me that my payment was misapplied since I have to accounts with them. I asked how that could be since I make sure I write the account number and send a statement that I had to make up myself. Still nothing was being done so I called there attorny's office and got through the Attorney or assistant told me that I was not supposed to contact Fairbanks that i had to go through them.

That is when I told her that I had found they were misappling the payments. She said that could not happen i said whatever that when I went to their court hearing with my proof that they were going to in for it for wasting the judges time. Aweek later I got a letter apologizing for the inconvience and it would be taken care of.in the last month they would post my 2nd mortgage payment and nver recieve my 1st. So I stop payment and sent them last months and this months I did this almost ten days ago and still it has not been posted.

While I was on the phone with there snotty customer service agents I found that they were Charging me over $900.00 for their attorey's fees over the last incident then I told them that they had misapplied the payment and that is why they had to get the attorney's involved they proceeded to look at my account history and seen that i was telling the truth and now it is going to take 80 days for them to right their wrong.

My main complaint is that they keep making my payment late and charging me for it or threatening to take my house away. My husband and I work very hard to keep a roof over our childrens heads not for some crappy company to keep threatening to take our house away. I am stuck between a rock and hard place because we filed bankruptcy we will never be able to leave this company all I can wish for is that they will be shut down. If any one knows a way of filing a report to a agency to get this company out of business please let me know.
