Refuses to refund money after my child was mistreated by other children in the classroom. Ripoff

I sent my son to Trinity Presbyterian Preschool. He was placed in a 2 day a week 3 year old classroom with 10 other children. 2 of the children did not speak English. The children in the room were hitting my child, bullying him and he came home crying after every day of school. I spoke with the teacher every day after school and she stated she didn't see anything going on. Finally, my son started having potty accidents and having nightmares about going to school there.

I pulled him out after 8 days of school (1 month of school). There payment policy is that you pay a nonrefundable registration fee and the first months tuition when you enroll them in the spring. The next payment is due October 1st. Then, another payment in Feb. So virtually you are paying much of the school year upfront. They state in a signed agreement by parents that the money is not refundable.

I called the school and spoke with the director and informed her of what was going on. She stated to me, she had not been aware of any problems and had not been in the classroom. She told me she would speak with the teachers and call me back. She did and reported we could not have our money back. I asked who was above her and she stated there was a board of directors and I could write a letter to the board. I asked if I could attend the meeting that following day and she said no. I wrote my letter and awaited a response.

She called back 4 days later with the same response... No money back. "we could move him to another classroom". He was so traumatized by the first classroom, he doesn't want to go to school at all! Same response by the director.

I then called the head Pastor of the Church and spoke with him at length. He informed me, he had nothing to do with the preschool. He teaches Chapel once a month and that is it. He is not even a member of the board. He told me he would speak to the director and the teachers and the board for me and call me back. The next morning he left a message on my phone stating he backs the staff and the board members of the preschool and there was nothing more for us to discuss.

The result for me is my child is traumatized by attending there 8 days for 3 hours per day. I am out $725 for tuition and a registration fee. I only asked for $300 back, the October payment that I made early in September. I paid it on September 12 and they cashed the check on September 20. I think it is appauling what they have done and especially a church preschool. Please help!
