EDP Reporting, ripoff

I am reporting this company just like countless others. I have also had $159.95 taken out of my checking account by EDebit Pay. It happened in June, I was on some website trying to get a payday loan, these ads for credit cards kept popping up. I pressed the "NO THANKS" button to continue on with the process of the loan. I'm thankful to say that I didn't get the loan, but about 2 or 3 days later my account was debited for $159.95. My bank gave me a copy of the check that was drafted and I called the 1-800 number on the check copy, unfortunately I got to leave a message. I received a call back yesterday, the young lady (Valeska) told me to take a fraud report (that they will mail me) to my local police precinct, have them fill it out, start an investigation and then fax it back along with my bank statement inorder for them to refund my money. She said that someone must have filled out the form on my computer, but I explained to her, my personal information was already in the boxes (my full name, phone number, everything), once I realized that it was not for the payday loan I clicked the "NO THANKS" button. Now, is it usual practice to file a fraud report with the police or should I go back to my bank?
