Fraudulant Billing, Excessive Rework, Refusal to Pay for Damaged Furniture & Owner's Time

Owner contracted PMI to perform remodeling work. At end of job after owner refused to pay anymore unless invoices were produced PMI submitted fraudulent, backdated and undocumented invoices for time and material remodeling work. PMI also, breached verbal contract criteria and completion time lines. There were excessive repairs of poor workmanship from sub-contractors and PMI employees. There was damage to owner's furniture due to repairs of poor workmanship, and added expenses to owner for self on-site management as PMI was not present unless owner was in town. PMI stated they had competitive rates for time and material work, when billed was charged $45.00 for basic labor (hanging towel racks, mirrors, etc.). Comparisons show $25.00 to $30.00 is competitive. Charged $1500.00 to remove and hang 10 sheets of drywall.insurance company estimated $245.00.invoices are so confusing one has to be a forensic accountant to follow. Double billed many times and changed quoted costs to higher figures. PMI failed Wellington City final inspection as did not call for inspection until after windows and sliding doors installed and owner moved in.inspector required PMI to remove 3 sliders and 2 large windows 5 months after installed to pass inspection. It took PMI 6 months to paint a 2100 square foot home when owner was told it would take 3 to 4 weeks. There was electrical and lighting rework which required three sub contactors, granite rework, damaged good cabinetry had to be repaired, removed floor tile not on initial list, had to re-hang wallpaper 4 times as poor prep work, underestimated paper by 6 rolls in master bathroom, overestimated in 3 rooms. PMI and its sub contactors had to rework bulk head and installation of 3 recessed lights in master bath 6 times. For 3 months PMI subcontractors damaged lights, wallpaper had to redo plaster work and painting. PMI failed to keep to do lists created by owner as no project sheet existed from PMI's project manager. Owner had to repeat job details constantly for 5 months. PMI's excuse is to blame owner due to too many changes to cover poor performance. Owner has documented initial project request. Only additions were: 30 ft of gutters, additional 15 ft of fencing in rear of home plus small dog 12" fencing, move plumbing 6" for new cabinetry, drill hole for cable and fix rotted corner of fascia. This was on a job that cost $70,000.00.

The owner is a professional Interior Designer for 25 years. PMI had more errors on this one job than in the total projects the owner experienced in all of the 25 years in the construction business.initially requested refund of overpayment of $1,161.75 which included owner expenses of damaged furniture (which PMI project manager reviewed damaged chairs and agreed to pay for damage) plus owner's expenses to visit site and manage project and rework. Owner then agreed to no payment and walk away. Now PMI filed a civil complaint against owner for $5000 (still no documentation of costs of material). Now owner will add the 47 hours of job management and 4 rolls of overestimated wallpaper that was not returnable due to PMI's failure to schedule paper hanger in schedule given to owner. The total refund requested is $4,960.95.
